Privacy Policy

Last updated: 5 August 2026

The49 Ltd ("we", "us", or "our") is committed to protecting and respecting your privacy. This Privacy Policy outlines how we collect, use, and protect your personal data when you visit our website the49.com ("Website").

1. What information we collect

When you contact us, we collect the information you provide, such as your name, email address, telephone number, organisation and the content of your message.

If you allow Analytics, Google Analytics collects identifiers and information about your browser, device, approximate location, referring page, pages viewed, timestamps and interactions with the Website.

If you allow Marketing, Apollo and the LiveIntent identity technology it uses may process an anonymous browser identifier, IP address, browser and device details, page URLs, referrer and campaign parameters. Apollo uses this information to identify visiting organisations and may return organisation-level engagement information. LiveIntent may also resolve encrypted or hashed identifiers where available.

2. How we use your information

We use personal data to:

  • Respond to enquiries and communicate about requested information
  • Understand how the Website is used and improve it, where Analytics is allowed
  • Identify business interest in The49 and support relevant business-to-business sales activity, where Marketing is allowed
  • Protect the Website, establish legal claims and comply with legal obligations

3. Legal basis for processing

We rely on legitimate interests to respond to enquiries and operate and protect our business. We rely on consent for optional Google Analytics and Apollo storage and access technologies and the associated processing described above. We may also process data where necessary to comply with a legal obligation or establish, exercise or defend legal claims.

4. Who receives your information

The49 Ltd is the controller for the processing described in this policy. We use trusted hosting, communications and professional-service providers where necessary to operate the business.

If you enable optional technologies, Google receives Analytics data and Apollo receives website-visitor data. Apollo’s tracker uses LiveIntent identity technology. These providers process information under their applicable contractual terms; they or their subprocessors may also act as independent controllers for purposes explained in their privacy policies.

We do not sell your personal data. We may disclose information where legally required, to protect legal rights, or as part of a business reorganisation.

5. International transfers

Google, Apollo, LiveIntent or their subprocessors may process information outside the UK, including in the United States. Where a restricted transfer is made, we use an applicable UK transfer mechanism, such as adequacy regulations or approved contractual safeguards. Provider policies contain more information about their locations and transfer arrangements.

6. Retention and security

Enquiry information is kept only while needed to respond, manage any resulting business relationship and meet legal requirements. Google Analytics cookies may last up to two years, and user and event-level Analytics data is retained for no longer than 14 months. Apollo visitor information is kept only while relevant to our business-to-business sales activity and subject to provider account and contractual limits.

We use proportionate technical and organisational measures, including access controls and trusted service providers, to protect personal data. No internet service can be guaranteed completely secure.

7. Your rights

Depending on the circumstances, you may:

  • Access the personal data we hold about you
  • Ask us to correct or delete your data
  • Restrict or object to certain processing
  • Receive portable data where the right applies
  • Withdraw consent at any time, without affecting earlier lawful processing
  • Lodge a complaint with the Information Commissioner’s Office (ICO)

8. Cookies and withdrawing consent

Google Analytics and Apollo remain off unless you allow their categories. Use Cookie Settings or “Cookies & Settings” in the footer to change or withdraw your choice. Withdrawal stops future optional tracking on this device and removes known first-party tracking storage. Contact us to request deletion of information already received.

See our Cookie Policy for the technologies, storage names and retention information.

9. Changes to this privacy policy

We may update this Privacy Policy from time to time. We encourage you to review this page periodically for any changes.
